Accessing, browsing, and using the website www.nordy.es (hereinafter referred to as the Website) implies the express and unreserved acceptance of all the terms of these conditions, which have the same validity and effectiveness as any contract signed in writing.

Compliance will be enforceable against anyone accessing, browsing, or using the Website. If you disagree with the terms, do not access, browse, or use any part of the website.

2. Purpose and scope of application

These conditions govern access, browsing, and use of the Website www.nordy.es. Nordy reserves the right to modify the presentation, configuration, and content of the Website, as well as the conditions required for access and/or use. Accessing and using the Website after modifications implies acceptance of the changes.

Access to certain content and services may be subject to specific conditions, which will be clearly presented and must be expressly accepted by users. These specific conditions may replace, complement, or modify the general conditions.

Nordy reserves the right to modify these terms and conditions, in whole or in part, by publishing any changes in the same manner or through any form of communication directed to the users.

3. Access and registration

Access to the content of the Website is entirely free of charge, without prejudice to the fact that there may be specific sections or services that require the payment of a fee for their use or enjoyment, which will be duly informed in each case, and which the user must expressly accept should they wish to enjoy such services.

In the event that you do not have a username and password for access to our platform at http://oficinavirtual.nordy.es/, you must contact us by phone or email so that we may provide you with new access credentials. Once you access the portal, you will be able to change these credentials and review data related to your contract, your invoices, and your consumption history.

Access to the Virtual Office by minors is strictly prohibited. However, in the event that a minor gains access to the Virtual Office, it will be presumed that such access has been carried out with the prior and express authorization of their parents, guardians, or legal representatives, without prejudice to Nordy's right to conduct any verifications it deems appropriate.

Access and browsing of the Website do not require registration. However, to make any purchase or to receive advertising, information, and periodic offers from our promotional campaigns and products, it will be necessary to complete the corresponding web forms. Unless expressly stated otherwise, registration on the Website is free of charge.

Under no circumstances will Nordy be responsible for the accuracy of the registration data provided by users, meaning that each user is responsible for any consequences, errors, or failures that may subsequently arise from the lack of accuracy of the data provided.

3.1. Requirements for registering as a user

To register as a user, it is essential to be over 18 years old and provide all the required data deemed mandatory.

Likewise, the registered user acknowledges that their registered user account is personal and non-transferable.

Under no circumstances is the transfer of a registered user account between different individuals permitted. Nordy reserves the right to delete the account as soon as such a situation is detected, without prejudice to any legal actions that may correspond.

3.2. Deregistration as a registered user

Users may, at any time, request to deregister from the Website by submitting a written request via email to dpd@nordy.es, indicating their username and the specific service they wish to deregister from.

In any event, once deregistered, the user may request a new registration as a client, although Nordy reserves the right to deny such registration in cases specified in the clause entitled "Unauthorized Uses" or in the event of unresolved conflicts or disputes between the parties, or conflicts resolved in which the user has been found culpable or negligent, resulting in harm to Nordy, its collaborators and associates, or its users, clients, or potential clients.

 

4. Intellectual and industrial property rights

Nordy holds ownership or, where applicable, the corresponding licenses to exploit the intellectual and industrial property rights of the Website, as well as the intellectual and industrial property rights to the information, materials, and content on the Website.

Under no circumstances shall it be understood that access, browsing, and use of the Website by the user implies any waiver, transfer, license, or total or partial assignment of these rights by Nordy. The user is granted a right to use the content and/or services of the Website within a strictly domestic scope.

References to trademarks or registered trade names, or other distinctive signs, whether owned by Nordy or third-party companies, imply a prohibition on their use without the consent of Nordy or their legitimate owners. At no time, unless expressly stated otherwise, does access, browsing, or use of the Website and/or its content grant the user any right over the distinctive signs included therein.

All intellectual and industrial property rights over the content and/or services of the Website are reserved, and in particular, it is prohibited to modify, copy, reproduce, publicly communicate, transform, or distribute, by any means and in any form, the totality or part of the content included on the Website for public or commercial purposes, without the prior, express, and written authorization of Nordy or, where applicable, the owner of the corresponding rights.

The user acknowledges and agrees to assume responsibility, holding Nordy harmless for any communication provided personally or on their behalf, with this responsibility extending, without limitation, to its accuracy, legality, originality, and ownership.

5. Links

5.1. Links to other websites

In the event that the Website displays links to other websites via various buttons, links, banners, or embedded content, Nordy hereby informs users that such links are directly managed by third parties. Nordy neither has the means nor the human or technical resources to monitor or approve all the information, content, products, or services provided by third-party websites linked from the Website.

Consequently, Nordy cannot assume any responsibility for any aspect related to the linked website, specifically but not limited to, its operation, access, data, information, files, quality, and reliability of its products and services, its own links, or any of its content in general.

In this regard, if users become aware of any illegal activities carried out through such third-party websites, or activities that contravene morality and/or public order, they are requested to notify Nordy immediately so that the link may be disabled. Such action will be carried out as soon as possible.

In any event, the establishment of any kind of link from the Website to another external website does not imply the existence of any relationship, collaboration, or dependency between Nordy and the owner of the external website.

5.2 Links to the Website’s channel on other platforms and social networks

Nordy makes available to users, through various tools and applications, means of linking that allow users to access the Website’s channels and pages on different platforms and social networks operated and/or managed by third parties (e.g., Facebook, Instagram, X, etc.). The sole purpose of installing these applications on the Website is to facilitate user access to these channels on different platforms and social networks.

Under no circumstances does Nordy share any private user information with Facebook, X, or any other social network that may be incorporated in the future, with the sole purpose being as stipulated in these conditions and in the Privacy Policy. In this regard, any information that the user wishes to provide to these platforms will be at their own risk, with Nordy not intervening in this process.

The activation and use of such applications may require user identification and authentication (login/password) on the corresponding platforms, which are completely external to the Website and beyond Nordy’s control. By accessing such external networks, the user enters an environment not controlled by Nordy, and Nordy therefore assumes no responsibility for the security configurations of such environments.

As Nordy has no control over the content hosted on such channels, the user acknowledges and accepts that Nordy assumes no responsibility for the content or services that the user may access on these pages, nor for any content, products, services, advertising, or other materials available on them. For this reason, the user should exercise caution when assessing and using the information, content, and services available on linked channels and when providing information or sharing third-party information on such channels.

Nordy does not authorize the establishment of a link to the Website from websites containing unlawful, illegal, degrading, obscene, or otherwise inappropriate material, or material that violates the law, morality, public order, or generally accepted social norms.

Nordy does not have the ability or the human and technical means to monitor, control, or approve all the information, content, products, or services provided by other websites that have established links to the Website. Nordy does not assume any responsibility for any aspect related to the website that establishes the link to the Website, specifically, but not limited to, its operation, access, data, information, files, quality and reliability of its products and services, its own links, or any of its content in general.

6. Conditions of use of the Website

The following activities are strictly prohibited, and their consequences will be the sole responsibility of the user, whether carried out with or without financial intent:

 

1. Using the Website in any manner that may cause damage, interruptions, inefficiencies, or defects in its functionality or in the functionality of a third-party computer.

The breach of any of the above obligations by the user may result in Nordy taking appropriate legal measures and enforcing its rights and obligations, which may include the elimination or blocking of the user's account, without any right to compensation for damages.

Similarly, the Website includes areas where users can participate, post their own content, and/or share content, either their own or published by Nordy. These areas may be managed by Nordy, in which case they are dependent on and controlled by Nordy, or they may be external to Nordy, such as independent social networks. In such cases, Nordy cannot be held responsible for the proper functioning or the terms and policies set by the respective social networks, with the user solely responsible for consenting to and accepting the use of the information published on such platforms.

In any event, it is important to note that when users participate in any of these areas, other Website users will be able to access and use all content published by the user. Nordy cannot control how other people will use this content, and therefore, Nordy cannot be held responsible for such use. Nordy does not control the content posted by users on the Website and assumes no responsibility for such content. Nevertheless, Nordy reserves the right to monitor and/or moderate any content posted by users and to edit or delete any content that violates these conditions or the Privacy Policy.

If you find any information or content on the Website that is inappropriate, contrary to current regulations, or in violation of the conditions set out on this Website, we ask that you report it to Nordy immediately through the available communication channels.

 

7. Liabilities and warranties

Nordy cannot guarantee the reliability, usefulness, or accuracy of all the information and/or services on the Website, nor the usefulness or accuracy of the documentation made available through the Website.

Consequently, Nordy does not guarantee and is not responsible for: (i) The continuity of the content on the Website; (ii) The absence of errors in the content; (iii) The absence of viruses and/or other harmful components on the Website or the server providing it; (iv) The invulnerability of the Website and/or the inability to breach the security measures adopted on it; (v) The lack of usefulness or performance of the content of the Website; (vi) Any damages or harm caused to the user or third parties resulting from violations of the conditions, rules, and instructions set out by Nordy on the Website or from breaches of the security systems of the Website.

However, Nordy declares that it has taken all necessary measures, within its capabilities and the state of the art, to ensure the proper functioning of the Website and to minimize system errors, both from a technical perspective and in terms of the content published on the Website.

If the user becomes aware of the existence of any unlawful or illegal content, or content that infringes on intellectual or industrial property rights, data protection regulations, or any other rights, they must notify Nordy immediately so that appropriate measures can be taken.

Nordy will not be held responsible for the accuracy, completeness, or timeliness of information published on the Website from external sources (e.g., external news reports, professional assessments, etc.), nor for information hosted on other websites linked from the Website.

Nordy will not be responsible for any hypothetical damages that may arise from the use of such information. In no case will the content, opinions, comments, and/or links to third-party websites be considered recommendations, sponsorships, endorsements, or advertisements by Nordy for medications, healthcare products, or the laboratories or manufacturers that produce them.

Nordy reserves the right to suspend, modify, restrict, or terminate access to, browsing, use, or downloading of content and/or services of the Website, temporarily or permanently, with or without prior notice, to users who violate any of the provisions detailed in these conditions, without the user having the right to claim any compensation for this reason.

9. Applicable law and jurisdiction

These conditions are governed by Spanish law. The parties submit, at their choice, for the resolution of conflicts and with express waiver of any other jurisdiction, to the courts and tribunals of the user's domicile.

To file complaints regarding the use of our services, the customer may send an email to the electronic or physical address indicated in the "Company Details" section, committing to always seek an amicable resolution to the conflict.
